The short version: Use voibly responsibly, pay for what you use, keep your account secure, and we'll provide a reliable service. Either of us can end the relationship at any time.
1. Your account
You must be at least 13 years old (or 16 in the EEA) to create an account. You're responsible for keeping your credentials secure and for activity that happens under your account. Notify us promptly at support@voibly.app if you suspect unauthorized access.
2. Acceptable use
When you use voibly, you agree not to:
- Use the service for anything illegal, infringing, deceptive, or harmful to others.
- Attempt to reverse-engineer, decompile, or extract our models or source code, except as expressly permitted by law.
- Resell, sublicense, or rent voibly without our written permission.
- Use voibly to dictate or transmit content you don't have the right to record or share.
- Send malware, spam, or use voibly to flood third-party services.
- Probe, scan, or test the vulnerability of our systems without prior written authorization. Authorized researchers should follow our responsible disclosure program.
We may suspend or terminate accounts that violate these rules.
3. Plans & payment
voibly offers Free, Pro, and Lifetime plans.
- Free is offered indefinitely with usage limits described on the pricing page. We may change those limits with reasonable notice.
- Pro is billed monthly or annually. Subscriptions renew automatically until canceled. You can cancel at any time from Settings → Billing; cancellation takes effect at the end of the current billing period.
- Lifetime is a one-time purchase that grants Pro features for as long as the product exists. If we discontinue voibly, we'll provide reasonable advance notice and a transition path.
- All prices are in USD unless otherwise noted. You're responsible for applicable taxes.
- Payments are processed by Stripe and are subject to their terms.
Refunds
If you're unhappy with Pro within 14 days of your first payment, email support@voibly.app and we'll refund you. Lifetime purchases are refundable within 30 days of purchase.
4. Your content
Anything you dictate or input through voibly remains yours. We don't claim ownership of your text, your audio, or your snippets.
To run the service, you grant us a limited, non-exclusive license to process your content solely to provide voibly to you (for example, to transcribe audio you've sent to cloud-polishing mode). This license ends when you delete your content or close your account.
5. Our intellectual property
The voibly software, brand, marks, and documentation are owned by voibly Inc. and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to install and use voibly on devices you control, for your personal or internal business use, while your account is in good standing.
6. Third-party services
voibly may integrate with third-party services (e.g., Stripe for payments, AWS for cloud features). Your use of those services is governed by their own terms; we aren't responsible for them.
7. Disclaimers
voibly is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that voibly will be error-free, uninterrupted, or perfectly accurate. Always review dictated text before sending.
8. Limitation of liability
To the maximum extent permitted by law, voibly's total liability for any claim arising out of or relating to these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100. Neither party is liable for indirect, incidental, consequential, special, or punitive damages.
9. Indemnification
You agree to defend and indemnify voibly Inc. against claims arising from your misuse of the service or your violation of these Terms or applicable law. This doesn't apply to claims caused by our own gross negligence or willful misconduct.
10. Termination
You can close your account at any time from Settings → Account. We can suspend or terminate your account if you breach these Terms, with or without notice depending on the severity. After termination, sections 4–9, 12, and 13 survive.
11. Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll notify you at least 30 days in advance by email and via an in-app notice. Continued use after the change takes effect means you accept the updated Terms.
12. Governing law & disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, except where prohibited by your local law.
If you're a consumer in the EEA or UK, nothing in these Terms limits your statutory rights.
